I've been a Merchant before, I use to make 8 Million on 200 ships a day.

This is mainly to encourage the usage of escorts in trade fleets.

I would guess any ship that has a 30-40 crate hold would be classed as a warship or any ship with a cargo hold of 60 or less with howker being the exception.

Interesting rule proposal CJ regarding tail ship and inability to put a warship as tail in 6 ship fleets.

Putting a warship as tail would ensure a higher plunder take as generally warships are more valuable than trade ships,.. no ?

Be really nice to find a trade fleet with frig/sotl as a tail as the plunder purse goes up based on value of last ship that fought ? Or, is it cargo worth that determines plunder worth ?
I'm interested in this proposal but actual definition of Warships could be clarified if any different than my interpretation.

Also, what do you classify a Flag Galleon as, as it has 100 Cargo space, but can be used as either a trader or warship?

The classification is clear. Every ship is classified as either "war" or "merchant". Click on a ship, and you will see that it has a "type". Every ship above LMMs are "war", I think.

In my opinion CJ trying to tell if you would use at least 4 merchant ship you will be available for 6. spot as a warship spot. but you cant put it at the end of fleet. you should carry it as a head ship. With that ship numbers he just trying to show current order.
