I think the key word here is danger MANIPULATION. it doesn't matter if you arrange the battle beforehand or not, you are still manipulating your danger rating in a way that provides an unfair advantage. As noted in the rules section, bending the rules is still unacceptable. Here, you are bending the danger manipulation rule by trying to use the excuse that nothing was prearranged. This should still be counted as a violation in my opinion.
