Hum, piracy was totally illegal itself : I doubt much attention was ever paid to contraventions of this rule by pirates! What is true is that there was never a uniform 'Black Flag' or any requirement to actually fly it : pirates tended to fly a black-colored flag to mark themselves out as free and outside of nations laws, each crew had their own design and/or wording on them : it was also perhaps designed to instill fear in their prey and an easy surrender : resistance did tend to lead to a much harder time for the victims crew.
But that aside, I do agree the pirate should always get first the volley away versus a merchant ship : that not so true of facing a war-ship : the pirates inclination then was to high-tail it over the horizon : a war-ship would be stood-to and ready for action at the first sighting of a strange sail, never-mind their flag.
