Dez, I would think that in this scenario, since both players must select attack for the main mechanics to kick in, both are at the same risk of loss.

Both players are agreeing even though it was initiated by one. If fleet make up is hidden like on the port gossip page, the initiator may be running into a hornets nest. Imagine running into one of Pheonixknight dragon fleets. Many players now are running escorted trade fleets as well. Some of those trade fleets are more stout than the war fleets I sail.

Make it more interesting and take the identifiers out of this mechanic. If you initiate a spotted proximity fleet, you may only be able to see the flag flying, not the name of the fleet, the Captain, or the fleet configuration.

That would make this interesting.

Scenario

UK and Spain are at war. As you sail into Hannes you spot a fleet on the horizon. Your lookout informs you it is flying a Spanish flag. You initiate only knowing the country of origin.

Upon acceptance of the enemy fleet you find out you have just initiated a battle with the infamous Stan Rodgers patrolling the waters to protect his trade fleets.

I like the idea but I'd want / need to know the fleets makeup I am about to engage.

I'd surely glass the waters for ship types before opening my gun ports.

Maybe add that as a tech. Spotter capabilities. Higher tech the more information available.

One of the choices is to recon the fleet first.
However this mean the other fleet could attack first or escape while you are doing recon. If they choose to hit you blind.

It doesn't matter that battle is only with other players who choose to use the system. Battles are battles. Skirmish and Plunder are both battles. The benefits and circumstances may be different, but in the end it is a battle and danger is accrued.

You are missing the entite point of this. Danger has no purpose in these battles. Which are completely different from the rest of the combat system.

But if you dont like it, dont try it. You cant be attacked if you dont opt in.
