as his lawyer, i would like to sate he said currently meaning it is subject to change and he didn't say he is selling it he said it is just there so lady's and gentlemen of the jury i leave it to you

As counsel for the Plaintiff in this class action suit i put forth the following.

Under USC 16 CFR238.1 - Bait advertisement is defined as an "advertisement containing an offer to sell a product should be published when the offer is not a bona fide effort to sell the advertised product."

Also

(a) "No statement or illustration should be used in any advertisement which creates a false impression of the grade, quality, make, value, currency of model, size, color, usability, or origin of the product offered, or which may otherwise misrepresent the product in such a manner that later, on disclosure of the true facts, the purchaser may be switched from the advertised product to another."

The simple fact that people visited the market to purchase said SOTL at 1 cr. in fact shows that said post is an advertisement to sell. Furthermore, if the defendant in question is in fact the current owner/lister of said product, by definition, the post was an offer to sell, hence an "advertisement" defined under USC 16 CFR238.1 as stated above.

(b) Even though the true facts are subsequently made known to the buyer, the law is violated if the first contact or interview is secured by deception.
