Question: If you cast tidal wave on a port say Aiora. And there is a empty Man-Of-War can the wave take it.

yes it can. i can remember a player one time getting a man of war from a tidal wave. Maybe with the tidal wave we could make it rare and give it a 5 percent chance of man of war.

As I read it in earlier forum posts : any ship, in or out of fleet, active or inactive player, can be taken by a TW if it has no crew on board. Sunk ships are included as having 'no crew' : theoretically, you could take a ship that was in process of being built before the owner has a chance to crew it... but that would be a rare bit of timing...

ouch :(

Well, ever since I read that bit on the 'no crew' definition, first thing I do after building or ahem, borrowing, is crew it, then I level-up... paranoid maybe, but it seems it can and does happen...
